Rulings on Traffic Accidents in Islamic Law

Abstract

 This paper seeks to elucidate the legal rulings of modern traffic accidents within the principled framework of Islamic jurisprudence (fiqh). Since mechanized modes of transportation did not exist in earlier periods, explicit rulings regarding such incidents are not directly found in the Qur’an and Hadith. However, given the comprehensive nature of Islamic law, general legal maxims and juristic principles provide a sound basis for addressing contemporary issues. This study, therefore, attempts to analyze modern traffic accidents through analogical reasoning (qiyās), drawing upon classical juristic discussions related to injuries caused by animals. The paper outlines key foundational principles, including the shared right of public pathways, the condition of safety in their use, the limits of legal accountability (taklīf), the distinction between direct and indirect liability (mubāshir and mutasabbib), and the role of control and agency. In light of these principles, various forms of traffic accidents are examined, distinguishing between unilateral and bilateral incidents. The study concludes that liability (ḍamān) and financial compensation (diyah) become obligatory in cases involving negligence, transgression, or violation of law on the part of the driver. Conversely, in situations where the incident occurs beyond human control and without fault, no liability is imposed. Furthermore, the paper emphasizes that compliance with state-enforced traffic regulations constitutes a religious obligation. Violating such laws is not only a legal offense but also a morally and legally accountable act in Islamic law. The study ultimately demonstrates that the principles of Islamic jurisprudence are sufficiently flexible and comprehensive to be applied to emerging issues, enabling a systematic and reasoned determination of rulings concerning modern traffic accidents.
