Abstract

In the contemporary digital era, inheritance is no longer confined to physical assets but increasingly encompasses digital properties, including social media accounts, crypto currencies, emails, and cloud-based data. This analytical study examines the concept of digital inheritance in Pakistan, focusing on the legal gaps that significantly impact the rights of heirs. Despite the growing importance and economic value of digital assets, Pakistan’s legal system remains largely rooted in traditional inheritance frameworks, which do not adequately address issues related to access, transfer, ownership, and management of digital property after an individual’s death.The study explores the intersection of Islamic inheritance principles and modern digital realities, analyzing whether existing jurisprudence can effectively accommodate emerging forms of intangible assets. It further highlights critical challenges such as data privacy concerns, lack of public awareness, absence of clear legal definitions, jurisdictional complexities, and the unavailability of specific legislative provisions governing digital inheritance. Additionally, technological barriers and restrictions imposed by digital service providers further complicate heirs’ access to such assets.Using a qualitative and analytical methodology, this research identifies the practical difficulties faced by heirs and legal authorities in claiming and managing digital assets. The study also incorporates a comparative perspective by examining international legal developments and best practices in this field. It concludes by emphasizing the urgent need for comprehensive legal reforms in Pakistan to bridge existing gaps and ensure the effective protection of heirs’ rights in the digital domain, in harmony with both contemporary legal standards and Islamic principles.
